RETROMANIA DISTANCE SALES AGREEMENT

1. PARTIES

This Distance Sales Agreement (“Agreement”) has been signed between the following parties under the terms and conditions stated below:

B. "SELLER"; (hereinafter referred to as "SELLER" in the agreement)

By accepting this agreement, the BUYER agrees in advance that if the order subject to the contract is approved, the BUYER will be under the obligation to pay the price of the order and additional fees such as shipping and taxes, if any.

2. DEFINITIONS

In the implementation and interpretation of this agreement, the following terms refer to:

a) "Minister": The Minister of Trade,
b) "Ministry": The Ministry of Trade,
c) "Law": Consumer Protection Law No. 6502,
d) "Regulation": Distance Contracts Regulation (Official Gazette: 27.11.2014/29188),
e) "Service": Any consumer transaction other than providing goods made or committed to be made in return for a fee or benefit,
f) "Seller": The company that offers goods to the consumer within the scope of its commercial or professional activities or acts on behalf or account of the provider,
g) "Buyer": The real or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes,
h) "Website": The SELLER's website retromaniashop.com,
i) "Orderer": The real or legal person who requests goods or services via the SELLER’s website,
j) "Parties": The SELLER and the BUYER,
k) "Product": The movable goods subject to shopping and software, audio, visual, and similar intangible goods prepared for use in electronic environment.

3. SUBJECT

This Agreement regulates the rights and obligations of the parties pursuant to the provisions of Law No. 6502 on Consumer Protection and the Distance Contracts Regulation regarding the sale and delivery of the product(s) whose features and sales price are specified below, ordered by the BUYER electronically via retromaniashop.com.

4. CONTRACTUAL PRODUCT(S) INFORMATION

The basic features (type, quantity, brand/model, color, quantity) of the product/products are available on retromaniashop.com. The SELLER is not responsible for price updates caused by technical errors.

Prices listed and announced on the site are the selling prices. The announced prices and promises are valid until updated or changed. Prices declared for a limited period remain valid until the end of the specified period.

The sales price of the contractual product, including all taxes, is shown below.

5. DELIVERY METHOD AND PLAN

The product will be delivered to the BUYER’s provided address through the SELLER’s designated cargo company. The delivery period starts once the order is confirmed and does not exceed the legal period of 30 days.

6. GENERAL PROVISIONS

6.1. The BUYER acknowledges that they have read and are informed about the essential qualities, sales price, payment method, and preliminary information regarding the delivery of the contractual product on retromaniashop.com and confirms the transaction electronically.

6.2. The SELLER is responsible for delivering the product in accordance with the specifications stated in the order and with warranty documents and user manuals if applicable.

6.3. If the contractual product is to be delivered to a third party other than the BUYER, the SELLER is not responsible if the third party refuses to accept delivery.

6.4. The SELLER is responsible for ensuring the ordered product is undamaged, complete, and in accordance with the order requirements.

6.5. If the SELLER fails to fulfill the contractual obligations due to force majeure circumstances, they will inform the BUYER. The BUYER has the right to cancel the order or request a replacement.

7. RIGHT OF WITHDRAWAL

7.1. The BUYER may exercise their right of withdrawal within 14 days from receiving the product without any justification and without incurring any penalties.

7.2. To exercise the right of withdrawal, the BUYER must notify the SELLER via email or written communication and return the product unused, undamaged, and complete with its invoice and packaging.

8. DISPUTE RESOLUTION
